One Texas lawmaker is warning that an accused wife-killer’s escape to Italy, which forced prosecutors to remove the death penalty as a possible sentence, could open a “pandora’s box” for future criminals.
Lee Gilley, 39, has been charged with capital murder in the October 2024 death of his wife, Christa, who was nine weeks pregnant at the time of her death. The Harris County Medical Examiner’s office ruled her death a homicide caused by neck compression. Gilley has entered a not guilty plea.
According to authorities, Gilley cut off his ankle monitor on May 1 and fled Texas before his trial was set to begin. Court records indicate he traveled to Milan Malpensa Airport in Italy under a false identity and with forged travel documents. Italian authorities subsequently took him into custody.

Dick DeGuerin, Gilley’s U.S. attorney, previously told Fox News Digital that Italian judges required a written guarantee that prosecutors would not pursue the death penalty before it would consider returning him. He said Italian authorities may also seek assurances that Gilley would not face a sentence of life without parole.
“Most civilized countries in the free world have abolished the death penalty,” he told Fox News Digital on Tuesday. “The U.S. and Texas should do the same, in my opinion after spending 61 years of my adult life in the criminal justice system.”
The Harris County District Attorney’s Office announced in direct response to the Italian judges that it won’t be pursuing the death penalty against Gilley, but stopped short of pledging not to pursue life without parole, noting that he could be eligible for commutation.

Texas State Representative Brian Harrison told Fox News Digital he’s very concerned about the prospect of a European country controlling how criminals are sentenced in his state.
“You’re almost opening Pandora’s box in sort of a roundabout way, allowing … some of those European socialist soft on crime liberal politicians to be able to wield influence over what happens in Texas courts,” Harrison said. “I do not want foreign governments, foreign officials, foreign courts having anything to do with how we enforce criminal laws here in the state of Texas.”

He also said this could create a horrible precedent for future suspects who may want to find creative ways to reduce their potential sentence.

“If you can somehow, once you’re out on bond, just touch foot on foreign soil and then turn the extradition hearings into basically a way to whittle down potential punishments … the implications are profound and very concerning to me,” Harrison said.

A hearing was held before the Turin Court of Appeal on Sept. 7. DeGuerin told Fox News Digital that Gilley’s extradition was again delayed.

During a July 15 hearing at the Turin Court of Appeal, Gilley said he is seeking protection in Italy, according to NBC News. The Turin Court of Appeal blocked the extradition request during a hearing on July 20.

Gilley’s Italian attorney, Monica Grosso, previously said Christa had a blood disorder and that blood discovered in the couple’s bedroom did not align with the prosecution’s version of how she died.

“I am seeking protection in Italy,” Gilley said. “They want to punish me, and I am asking for protection for myself and my children.”
