A ruling on whether the case against the wife and daughter of former acting mob boss John “Junior” Gotti has been put off to the end of the month.
Kimberly Gotti, 56, and her 25-year-old daughter, Gianna, in February were charged in connection with a basketball game brawl on Long Island.
In a new 150-page filing, lawyers for the pair argued prosecutors have taken too long to bring the case to trial and said it should be tossed as a result. The defense further claimed prosecutors withheld a prior criminal record of the woman who was allegedly attacked.
The Nassau County District Attorney’s Office in response said they still have two months to present their case. It also said the prosecution was not initially aware of the prior misdemeanor conviction, but shared that information as soon as it was made aware.
A judge had been slated to hear arguments on Tuesday in First District Court in Hempstead to determine if the case will go forward. Instead, court was adjourned until July 30.
According to a police report obtained by ABC 7, a man and a woman were shouting vulgarities at students from the stands during the showdown between Oyster Bay High School and home team Locust Valley High School on February 7. A witness said the mother-daughter duo became irate when another parent present asked them to stop. The tension ultimately escalated to violence, with both Kimberly and Gianna accused of beating up and punching the 48-year-old woman who made the request.
They each face a count of third degree assault with intent to cause physical injury.
The Gotti women in May rejected a plea deal that would have seen them plead guilty to a misdemeanor charge and attend anger management classes. They have also denied being the instigators of the altercation.
