Justin Timberlake was not intoxicated, attorney says after DWI hearing

Justin Timberlake’s attorney appeared in a New York courtroom on his behalf Friday morning to address charges stemming from the singer’s DWI arrest the Hamptons last month and stridently affirm that his client was not intoxicated.

The 43-year-old Grammy winner, who is in Europe performing his “Forget Tomorrow World Tour,” was not present for the hearing. He has two shows scheduled in Kraków, Poland this weekend.

“The most important thing we have to say today is that Justin should not have been arrested for driving while intoxicated,” his attorney, Edward Burke told reporters, adding that authorities made “a number of very significant errors” in connection with the case.

“Sometimes the police, just like every one of us, make mistakes, and that is the case in this very incident,” he added.

“I will say that Justin respects law enforcement. I will say that he recognizes the very important job that they do, and he cooperated with police officers from the second he was ordered out of his car to the second he was discharged,” Burke concluded.

“The facts remain, he was not intoxicated. I’ll say it again: Justin Timberlake was not intoxicated. And we’re very confident that that criminal charge will be dismissed.”

Timberlake, who was driving a 2025 BMW, was pulled over early the morning of June 18 after he allegedly blew through a stop sign in Sag Harbor, not far from the American Hotel. He was leaving the popular restaurant when he was stopped and charged with one misdemeanor count of driving while intoxicated.

The officer who pulled him over alleged that “his eyes were bloodshot and glassy, a strong odor of an alcoholic beverage was emanating from his breath, he was unable to divide attention, he had slowed speech, he was unsteady afoot, and he performed poorly on all standardized field sobriety tests,” according to a criminal complaint against him.

The singer told the officer he had one martini and that he was following some friends home at the time, according to the documents.

Timberlake was also cited for for running a stop sign and failure to stay in his lane. He was released without bond the morning after his arrest, and he went on to perform two nights in Madison Square Garden as part of his tour, his first in five years.

In New York, a misdemeanor DWI conviction could result in up to one year in jail and $500 to $1,000 in fines
