The 4-year-old boy found not breathing in his family’s Harlem apartment was previously investigated by ACS for malnutrition — which he was suffering from when he died — but investigators did not substantiate the allegation, a law enforcement source said Tuesday.
The city medical examiner is conducting an autopsy to determine little Jahmeik Modlin’s cause of death.
His 26-year-old mother, Nytavia Ragsdale, was charged Monday night with criminally negligent homicide and endangering the welfare of a child. Her arraignment was pending in Manhattan Criminal Court Tuesday.
Investigators will review interactions the city Administration for Children’s Services had with his family.
The law enforcement source said ACS had previously investigated a complaint that Jameik was malnourished. The complaint was unsubstantiated, the source said, though further details were not immediately available.
The source also said the boy was born with marijuana in his system.
Police were called Sunday evening to the family’s apartment on Adam Clayton Powell Jr. Blvd. near W. 145th St.
When officers arrived Ragsdale was already outside with her son and told officers he was unconscious.
Medics rushed the boy to Harlem Hospital, where he died.
In addition to being malnourished the boy was hypothermic, police sources said. Police at first thought he had burns on his body but those markings were later determined to be severe eczema, one of the police sources said.
